]Reservation & Group Guidelines The Pickle Pad offers court rentals in increments of 1 hour, 1.5 hours, and 2 hours, with each court accommodating up to 8 guests. For parties requiring more than one court (9 to 18 guests), bookings must be made as a "9+ Group" to guarantee side-by-side court placement; groups that book multiple courts as separate reservations are not guaranteed adjacency. For larger gatherings of over 18 guests, please contact our Events Department directly to ensure proper court allotment for your party. 1. Acknowledgment and Assumption of Risk I, the participant, acknowledge that participation in pickleball and/or usage of a golf simulator, including but not limited to open play, lessons, clinics, tournaments, and other activities at The Pickle Pad (the Facility), involves inherent risks that may include but are not limited to physical injury, damage to property, or death. These risks may result from my actions, inactions, or negligence, as well as the actions, inactions, or negligence of others, or the condition of the premises or any equipment used. I fully understand that pickleball activities involve physical exertion and may include risks such as slipping, falling, collision with other participants, or being struck by a ball or paddle. I voluntarily assume all risks associated with participation in any activities at the Facility, whether identified in this waiver or not. I also voluntarily assume all risks associated with attending The Pickle Pad in any capacity, as I am aware that others may participate in activities at the Facility, whether identified in this waiver or not. 2. Release of Liability In consideration of being allowed to participate in pickleball activities and to use the Facility’s equipment and premises, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, discharge, and covenant not to sue The Pickle Pad, its owners, employees, agents, contractors, volunteers, and any other affiliated parties (the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that I may sustain while participating in pickleball activities or while on the premises, whether caused by the negligence of the Released Parties or otherwise. 3. Indemnification I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorneys’ fees, arising out of or related to my participation in any activities at the Facility or my presence on the premises, including any claim made by a third party due to my conduct. 4. Medical Consent I understand that participating in pickleball activities can result in physical injury, and I hereby authorize The Pickle Pad to secure, at my expense, medical treatment in the event of injury, illness, or accident during any activities at the Facility. I also understand that I am solely responsible for all medical costs associated with such treatment. 5. Equipment and Facility Usage I acknowledge that I am responsible for inspecting the condition of the equipment and the Facility before each use. By participating in activities at the Facility, I certify that I have inspected the premises and equipment and found them to be safe and suitable for participation. If I notice any hazards or unsafe conditions, I will immediately report them to Facility management and refrain from participating until the condition is remedied. If I damage any equipment at the The Pickle Pad facility or and part of the facility itself, I understand that I am financially responsible for replacing or fixing any and all items at a cost determined by The Pickle Pad. 6. Compliance with Rules and Regulations I agree to abide by all rules and regulations set forth by The Pickle Pad, including any safety instructions or guidelines provided by Facility staff. I understand that failure to comply with these rules and regulations may result in my removal from the Facility and the termination of my privileges to participate in any activities. 7. Responsibility for Additional Players By making a reservation at The Pickle Pad, I am confirming that I am 18 years of age or older. I acknowledge that by reserving a pickleball court or golf simulator at The Pickle Pad, I am agreeing to this waiver and release of liability agreement on behalf of myself and all other players included in my reservation. I understand and agree that it is my responsibility to inform all additional players participating at my reserved court or simulator of the terms of this waiver, and I accept full responsibility for their compliance with the terms and conditions herein. I further acknowledge that I assume all risks and liabilities associated with the participation of these additional players. The Pickle Pad requires all children under the age of 18 must be accompanied by an adult, at a minimum ratio of one adult to supervise every four children. By agreeing to this waiver, I confirm all members of my reservation will abide by this guideline. 8. Photography and Video Release I understand that The Pickle Pad may take photographs or videos during activities for promotional or marketing purposes. I hereby grant The Pickle Pad the right to use, reproduce, and publish any images or videos of me, without compensation, for any lawful purpose, including advertising, social media, and website content. 9. Governing Law and Jurisdiction This waiver and release of liability agreement shall be governed by and construed in accordance with the laws of the state of Florida. Any legal action or proceeding arising out of or related to this waiver shall be brought exclusively in the courts of Leon County, FL. 10. Severability If any provision of this waiver and release of liability agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. 11. Cancellation Policy Reservation changes and reservation cancellation can be made up until 24 hours prior to the reservation start time to receive a refund. On the day of your reservation, you have until 10 minutes after the reservation start time to arrive and check in before your court may be given away to another party. 12. Entire Agreement This waiver and release of liability agreement constitutes the entire agreement between The Pickle Pad and the participant and supersedes any prior or contemporaneous understandings, whether written or oral, regarding the subject matter of this agreement. By reserving this activity at The Pickle Pad, I acknowledge that I have read this waiver and release of liability agreement, fully understand its terms, and agree to them freely and voluntarily on behalf of myself and all additional players included in my reservation.
